Agreement between you and Mail Tuner

The Mail Tuner marketing website at mailtuner.co, client dashboard at acc.mailtuner.co, service dashboard at service.mailtuner.co, and related applications (collectively, the “Site”) are operated by Mail Tuner. Mail Tuner is offered to you on the condition that you accept these Terms and Conditions (the “Terms”) without modification. Your use of Mail Tuner constitutes your agreement to all such Terms. Please read them carefully and keep a copy for your reference.

Mail Tuner is an email deliverability platform that helps legitimate senders warm up domains and mailboxes, monitor sender reputation, track inbox placement, and protect sending infrastructure.

Privacy

Your use of Mail Tuner is subject to our Privacy Policy, which also governs the Site and describes our data collection practices.

Electronic communications

Visiting Mail Tuner or sending emails to us constitutes electronic communications. You consent to receive electronic communications from us and agree that agreements, notices, disclosures, and other communications we provide electronically — by email or through the Site — satisfy any legal requirement that such communications be in writing.

Your account

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for restricting access to your devices. You agree to accept responsibility for all activities that occur under your account. You may not assign or transfer your account to another person or entity without our prior written consent.

You acknowledge that Mail Tuner is not responsible for unauthorized access to your account that results from theft, misappropriation, or misuse of your credentials. We may refuse service, terminate accounts, suspend access, or remove or edit content in our sole discretion, subject to applicable law.

Subscriptions, billing, and payments

Paid plans, trials, renewals, and add-ons are described on the Site and in your account. By subscribing, you authorize us and our payment processors (such as Stripe or cryptocurrency payment partners) to charge applicable fees on a recurring basis until you cancel in accordance with your plan. Prices, features, and billing intervals may change; we will provide notice where required by law before material changes take effect.

Except where required by law or expressly stated on the Site, fees are non-refundable. Failure to pay may result in suspension or termination of paid features.

Connected mailboxes and third-party accounts

You may connect Gmail, Google Postmaster Tools, Microsoft, or other provider accounts through OAuth or other authorized methods. By connecting a third-party account, you authorize Mail Tuner to access and use information from that account as needed to provide the Services, in accordance with your provider permissions and our Privacy Policy.

If you do not want information to be shared in this manner, do not connect third-party accounts. You remain responsible for compliance with your email provider’s terms and applicable anti-spam and marketing laws for mail sent from your connected mailboxes.

Acceptable use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use Mail Tuner strictly in accordance with these Terms. You warrant that you will not use the Site or Services for any unlawful purpose or in any manner prohibited by these Terms.

You may not use the Site in a way that could damage, disable, overburden, or impair Mail Tuner or interfere with others’ use. You may not attempt to obtain materials or information through means not intentionally made available through the Site, scrape or harvest data without permission, reverse engineer the Services except where prohibited by law, or use Mail Tuner to send spam, phishing, malware, or other abusive or illegal content.

Intellectual property

All content included in or made available through the Services — including text, graphics, logos, images, software, and compilations thereof — is the property of Mail Tuner or its licensors and is protected by copyright, trademark, and other laws. You agree to observe and abide by all proprietary notices and restrictions.

You will not modify, publish, transmit, sell, or exploit Site content except as expressly permitted by these Terms or with our prior written consent. Your use of the Site does not grant you ownership rights in any protected content.

Children

Mail Tuner does not knowingly collect personal information online from children under the age of thirteen. If you are under the age of majority in your jurisdiction, you may use Mail Tuner only with permission of a parent or legal guardian.

Links to third-party sites and services

The Site may contain links to third-party websites or services (“Linked Sites”). Linked Sites are not under our control, and we are not responsible for their content, policies, or practices. Links are provided for convenience only and do not imply endorsement.

Certain features are delivered by third parties (hosting, payments, OAuth providers, analytics). By using those features, you acknowledge that we may share information with subcontractors as needed to provide the requested functionality on behalf of Mail Tuner users.

International users

Mail Tuner may be operated from various locations. If you access the Services from outside your home country, you are responsible for compliance with local laws. You agree not to use Mail Tuner content or Services in any country or manner prohibited by applicable laws, restrictions, or regulations.

Indemnification

You agree to indemnify, defend, and hold harmless Mail Tuner, its officers, directors, employees, agents, and contractors from any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Site or Services, your content, your violation of these Terms, your violation of any third-party rights, or your violation of applicable laws. Mail Tuner may assume exclusive defense of any matter subject to indemnification by you; you will cooperate with our defense.

Dispute resolution and arbitration

If a dispute arises from or relates to these Terms and the parties cannot resolve it informally, the dispute shall be resolved by final and binding arbitration, except where prohibited by law. Arbitration shall be conducted by a single neutral arbitrator under rules mutually agreed by the parties or administered by a recognized arbitration provider. The arbitrator’s award shall be final and judgment may be entered in any court of competent jurisdiction.

To the extent permitted by law, disputes shall be brought on an individual basis only. Class, collective, representative, or private attorney general actions are not permitted. This arbitration provision survives termination of these Terms.

Liability disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ON OR THROUGH THE SITE MAY INCLUDE INACCURACIES OR ERRORS. CHANGES MAY BE MADE PERIODICALLY. MAIL TUNER AND ITS SUPPLIERS MAY IMPROVE OR CHANGE THE SITE AT ANY TIME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAIL TUNER AND ITS SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, OR ACCURACY OF THE SITE OR SERVICES FOR ANY PURPOSE. ALL INFORMATION, SOFTWARE, PRODUCTS, SERVICES, AND RELATED MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. MAIL TUNER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIL TUNER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF USE, DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Mail Tuner does not guarantee inbox placement, deliverability outcomes, or specific reputation scores. Deliverability depends on many factors outside our control, including recipient providers, list quality, and your sending practices.

Termination and access restriction

We may terminate or suspend your access to the Site and related services at any time, with or without notice, in our sole discretion, subject to applicable law. If you are dissatisfied with any part of the Site or these Terms, your remedy is to discontinue use.

These Terms are governed by applicable law in the jurisdiction where Mail Tuner operates its services, without regard to conflict-of-law principles. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
